Services provides global web hosting to many clients, and we have a
responsibility to provide each and every client with the best possible
service. The following guidelines have been established to insure this
intent is met.
Content: Note: Pornography and sex-related merchandising are prohibited on any Real Value Internet Services server. This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to Real Value Internet Services servers or any other server on the internet. Links to such materials are prohibited. This also includes, but not limited to pirated software, illegally distributed MP3s, hacker programs/archives, and Warez sites. Real Value Internet Services will be the sole arbiter as to what constitutes a violation of these provisions. Real Value reserves the right to refuse service and /or access to its servers to anyone. Real Value expressly forbids any server use for distribution, storing, processing, linking to or otherwise handling in any way the following:
Bandwidth Traffic Policies :We are pleased to offer our standard hosting clients with 8GIGS of web site data traffic allowance per month - surpassing the web hosting industry standard for traffic allowance. Please note that over 90% of all web sites never even go above 5GIGS of data traffic per month even if a site is relatively popular. However, to maintain the integrity of our system, domains that go extremely beyond their traffic allowance will be automatically disabled without notice to protect current users on the system. Domains that may be susceptible to going over the traffic allowance usually house enormously large files (zips, ROMs, mp3s, graphic galleries) or domains that house multiple main web sites. Extra traffic above 8GIGS may be purchased at discounted rates through our upgrade center. The Real Value Internet will notify the user ahead of time before any extra charges are applied. File Quotas and Backups
File quotas can be increased for a small monthly fee or can be waived if a customer does not wish to have any backups of the account's data implemented on our network. Email: Server abuse: ZERO TOLERANCE Real Value's policy concerning unsolicited email and cross-posting to Usenet newsgroups is immediate cancellation. If you engage in any of these activities on our network, your services will be terminated immediately, with no prior notice, and no refunds for unused portions of service will be granted. This policy has been developed not as a limit to network traffic, but as an issue of Internet etiquette. Money Back Guarantee: -DISCLAIMER- Real Value Internet Services cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Real Value Internet Services are resold. Thus, certain equipment, routing, software, and programming used by Real Value Internet Services are not directly owned or written by Real Value Internet Services. Moreover, Real Value Internet Services holds no responsibility for the use of our clients' accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to edit these policies without advance notice and reserve the right to remove any account without advanced notice for any reason Real Value Internet Services sees fit. PAYMENT POLICIES All accounts are set up on a prepaid basis. Setup fees are charged for all new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of prepayment. Real Value reserves the right to change prices and account features at any time. The customer is responsible to visit our web site regularly to be informed of feature changes and updates. All services sold on on a quarter, yearly or more period are guaranteed not to have a price change until the end of that period. Any cancellations or modifications in services included in a Special invalidates the Special price. Accounts set up after the 25th of the month will not be required to pay for that month. The payment received will go towards the next month, and an invoice will not be sent for that next month. Accounts are not prorated. Payment for the next month is is due on the 1st of that month. Credit card orders that are on a 'month-to-month', 'quarterly' and 'yearly' basis will be charged automatically to the card number on file. If for any reason the card does not clear with the bank on three attempts, the account is subject to suspension. Any account not brought current within a week of email notice or exceeding this time frame in any way is subject to suspension. Service fees will accrue during any period of suspension. No bills or invoices will be sent by regular mail. Invoices for those customers who pay by check will be sent on the 25th of the month prior to the month in which payment is due. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Real Value in writing of a request for termination of services. Cancellation requests must be received by the 25th of the month, or payment will be required for the next month of hosting. Checks returned unpaid (NSF) will be assessed a $20 charge. All payments are in U.S. currency. CANCELLATION Real Value reserves the right to cancel service at any time. Accounts paid for on a monthly or yearly basis, and cancelled before that term is up, may have funds prorated and paid by Real Value if Real Value institutes its right of cancellation. If cancellation is caused by customers violation of these policies, then no refund is due. The customer is responsible for all money owed on the account from the time it was established to the time that the customer receives confirmation by email that their cancellation request by letter, fax or via online form, has been received and processed. Due to security concerns, account cancellations ARE NOT accepted via email or by telephone. All account cancellations via US mail or fax must include a valid signature of the primary contact of the account, account name, reason for cancellation, and last 4 digits of credit card on file. If payment was made by check, the zip/postal code of the primary contact must be included. If due, refunds will be sent by Real Value check or credit card return within 30 days of receipt of cancellation. The account will be cancelled at the end of the current billing period, unless a date of cancellation is specified. Accounts not cancelled by the 25th of the month will be charged for the next month's hosting. Real Value Privacy Statement Real Value regards its clients' information with utmost respect and care. We believe it is important that our clients should have an expectation that the information they provide to Real Value is held in confidence and is used for internal business only. 1. Real Value will only collect and store information required for the effective operation of Real Value and its associated companies as an Internet presence provider. 2. Real Value may, from time to time, use our customer mailing lists for network updates, system information and general sales information. Real Value may in the future limit all mailings to those clients who want to participate. 3. Information on customer usage or traffic will be confidential and will not be made known to any individual or company where this information is not required for the operation of Real Value. 4. Customer passwords are confidential and will not be made available to any person or company outside of Real Value for any reason whatsoever. Never give your password to ANYONE! The employees of Real Value who would need your password to make changes will already have access without it. We will NEVER ask for your password. 5. Credit information will be held in confidence, however, it will be used in any way possible to aid in the recovery of delinquent or defaulting debtors. 6. All information will be stored as securely as possible while maintaining the ability for authorized Real Value staff to quickly and effectively access this information when required operational purposes. 7. Real Value will cooperate with law enforcement personnel and legal investigations of our users. All customer information, however, will be private unless ordered by a court to be surrendered this information.
Customer agrees that it shall defend, indemnify, save and hold Real Value harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Real Value, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Real Value against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Real Value's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Real Value's server. DISCLAIMER Real Value will not be responsible for any damages customers or their enterprises may suffer. Real Value makes no warranties of any kind, expressed or implied for services we provide. Real Value disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Real Value and its employees.
